1. Services

We provide AI-powered digital marketing, advertising, branding, creative, and web development services as agreed per project or plan. Our services include but are not limited to:

• Social Media Management & Content Creation
• Meta Ads (Instagram & Facebook) Management
• Google Ads (Search, Display, YouTube) Management
• Website Development & Landing Pages
• SEO & Organic Growth Strategies
• Branding & Design Services
• Creative Production (Video, Photo, Content)
• Marketplace Services (Amazon, Flipkart, Meesho)
• Outreach & Retention Campaigns
• Local Business Growth Strategies

All services are delivered based on the scope defined in the project agreement or proposal. We serve businesses in Kashipur, Uttarakhand, and across India with customized solutions.

2. Payments & Billing

• Payments are due as per the agreed schedule in the project proposal or invoice.
• For monthly retainers, payments are due at the beginning of each billing cycle.
• For one-time projects, a 50% advance payment is required before work begins, with the remaining 50% due upon completion and delivery.
• Payments are non-refundable unless explicitly stated in writing.
• Late payments may result in suspension of services and additional fees.
• All prices are in Indian Rupees (INR) unless otherwise specified.
• We reserve the right to adjust pricing for ongoing services with prior notice.

3. Intellectual Property

• All work, designs, content, and deliverables created by GEN Z AI ERA™ remain the property of GEN Z AI ERA™ until full payment is received.
• Upon full payment, ownership of the final deliverables is transferred to the client.
• We reserve the right to showcase completed work in our portfolio and marketing materials.
• Any client-provided materials (logos, images, content) remain the property of the client.
• Unauthorized use, reproduction, or distribution of our work without permission is strictly prohibited.
• All AI-generated content is created using licensed tools and platforms.

4. Client Responsibilities

• Clients must provide all necessary materials, access, and information in a timely manner.
• Clients are responsible for ensuring the accuracy and legality of any content or information provided.
• Clients must review and approve work within agreed timelines.
• Delays caused by client non-response or late provision of materials may affect project timelines.
• Clients are responsible for maintaining the confidentiality of their account credentials.

5. Limitation of Liability

• GEN Z AI ERA™ is not responsible for any indirect, incidental, or consequential damages resulting from the use of our services.
• We do not guarantee specific results, as digital marketing outcomes depend on various factors including market conditions, competition, and client input.
• Our maximum liability is limited to the total amount paid for the specific service in question.
• We are not responsible for any losses, damages, or issues arising from third-party platforms (e.g., Facebook, Google, Instagram, Amazon, Flipkart, etc.)
• We are not liable for any data loss, hacking attempts, or security breaches beyond our reasonable control.

6. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. This includes business strategies, customer data, financial information, and any other confidential materials. We will not share your information with third parties except as necessary to deliver our services. This confidentiality obligation survives the termination of this agreement.

7. Termination

• Either party may terminate the agreement with written notice as per the terms of the specific project or retainer agreement.
• In case of termination, the client is responsible for payment of all work completed up to the termination date.
• We reserve the right to terminate services immediately if the client violates any terms, fails to make payments, or engages in illegal activities.
• Upon termination, any outstanding deliverables will be provided upon full payment.

8. Refund Policy

• All sales are final unless otherwise agreed in writing.
• Refunds are not provided for services already rendered or work already completed.
• In case of project cancellation, any advance payments for work not yet completed may be refunded on a case-by-case basis, minus any costs already incurred.
• For monthly retainers, no refunds are provided for partial months.

9. Third-Party Platforms

Our services may involve third-party platforms such as Facebook, Instagram, Google, Amazon, Flipkart, Meesho, and others. We comply with the terms and policies of these platforms. We are not responsible for any changes, restrictions, or penalties imposed by these third-party platforms. Clients are responsible for ensuring their own compliance with these platforms' policies.

10. Website Use

• You agree to use our website for lawful purposes only.
• You shall not engage in any activity that may disrupt or damage our website or services.
• We reserve the right to restrict or terminate access to our website for any user who violates these terms.
• All content on our website is protected by copyright and intellectual property laws.

11. Changes to Terms

We reserve the right to update these Terms and Conditions at any time without prior notice. Any changes will be posted on this page with an updated revision date. Continued use of our services after any changes constitutes acceptance of the new terms. We encourage you to review these terms periodically.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts in Kashipur, Uttarakhand. By using our services, you consent to this jurisdiction.

13. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

14. Entire Agreement

These Terms and Conditions constitute the entire agreement between you and GEN Z AI ERA™ regarding the use of our services and supersede all prior agreements and understandings.
